Wp-Filebase; Language Runtime detected an invalid program

this is the exception i get once i try to activate wp-filebase from the plugin foldeR:

I was wondering if that is because the file is using the shorthandif

      else $cur_path =& $this->cat_path;

instead of:

 {$cur_path =& $this->file_path;}
else
{$cur_path =& $this->cat_path;}

I've tried this plugin and I've also tried this particular piece of code and I didn't get the an exception. Could you create simple test case I could run to see this?
